Terms and Conditions of Use

The company OUEDKNISS is a Limited Liability Company (SARL) with its registered office located at 12 Parc Ben Omar Kouba Alger, registered at the National Center of the Trade Register of ALGERIA under the registration number RC: 18 B 0999874 16/00, Service Provider (hereinafter "SARL OUEDKNISS").

Preamble

The company OUEDKNISS (hereinafter "SARL OUEDKNISS") provides on its digital platform (hereinafter "OUEDKNISS.COM") available on the website www.ouedkniss.com website functionalities and services , when the User visits or uses the website www.ouedkniss.com ("OUEDKNISS.COM") or subscribes to the services provided on OUEDKNISS.COM, or uses the OUEDKNISS.COM mobile and tablet application.

These General Terms of Use (hereinafter "GTU") aim to define the provisions applicable to users (individuals, natural or legal persons) (hereinafter "User") in the context of access and use of the information and services offered by SARL OUEDKNISS on OUEDKNISS.COM.

Article 1 Scope of Use of OUEDKNISS.COM:

OUEDKNISS.COM allows the User to discover various products and services published on OUEDKNISS.COM by other users independent of SARL OUEDKNISS and having no direct or indirect connection with it.
The use of OUEDKNISS.COM is subject to the prior acceptance of the various provisions set out in these GTU, the Privacy Policy on OUEDKNISS.COM.

The use of OUEDKNISS.COM can be done in two ways:
- Use without prior creation of an account.
- Use with the creation of a specific account.

The costs (internet connection, call credit, computer equipment, etc.) incurred by the User to access OUEDKNISS.COM are not the responsibility of OUEDKNISS.COM.

Article 2 User Account Creation:

Creating an account on OUEDKNISS.COM is subject to registration at: https://www.ouedkniss.com/auth/register and is exclusively reserved for individuals with full legal capacity, aged 19 and over, and with the power to contract as fixed by Article 40 of the Algerian Civil Code.

The User who has registered on OUEDKNISS.COM must validate their account; the validation is done through a phone call or sending an SMS from a local telephone number provided during registration.

The costs (internet connection, call credit, computer equipment, etc.) incurred by the User of OUEDKNISS.COM to validate their account are not the responsibility of OUEDKNISS.COM.

Article 3 Requirements and Process of Buying and Selling on OUEDKNISS.COM:

The information provided by the User in the ad must include essential elements for the other party to make an informed choice. The User assumes full responsibility in case of a mismatch between the ordered product or service and the delivered product.

To enable the ordering of a product or service, the User can either:
- Contact the user who posted the ad by phone, Ouedkniss messaging, or external messaging (Viber, WhatsApp, Telegram, etc.) if available.
- Contact the user who posted the ad via the order form accessible via the dedicated button visible on the ad if activated.

Article 4 User Commitment and Responsibility:

4.1 Any User publishing their products and/or services on OUEDKNISS.COM must ensure that the product and/or service in question:
- Is not a stolen object
- Is not a prohibited object or service for sale and/or rent by applicable laws and regulations
- Is not an official document issued by the state
- Is not a medicine or pharmaceutical product
- Is not alcohol or tobacco

Every User must have all the necessary authorizations for publishing an offer to sell or rent regulated products and/or services.
In the event of a breach of one or more of the above points, the User bears full responsibility for the consequences of these publications, and SARL OUEDKNISS is free to remove the relevant publication and suspend access to the User's account.

4.2 Any User who has registered on OUEDKNISS.COM declares and guarantees that all information provided during registration is true and correct.
Any User who has registered on OUEDKNISS.COM declares and guarantees that they will maintain the accuracy of such information by modifying their account if necessary.

4.3 The User remains solely responsible for the use and management of their space, identifiers, and passwords, which should not be disclosed or shared with third parties. In case of dissemination or use of these elements contrary to their purpose, SARL OUEDKNISS is free to terminate access to the User's Individualized Space.

4.4 The User offering their services on OUEDKNISS.COM is independent and retains full responsibility for the various administrative formalities incumbent upon them and for the service to be performed.

4.5 The User must comply with the access conditions to OUEDKNISS.COM, comply with applicable laws and regulations, provide accurate and truthful data regarding their personal information and profile, and regularly update them to preserve their accuracy. The User must fill out any form, use OUEDKNISS.COM services in accordance with their purpose, not disrupt or attempt to disrupt the operation of OUEDKNISS.COM.

The information provided by the User and published by them via OUEDKNISS.COM is established and disseminated under the sole responsibility of the User. The User is solely responsible for the accuracy, non-misleading nature, and completeness of the information on the services and products they offer. The User is responsible for defects and hidden defects when posting a product or service through OUEDKNISS.COM. SARL OUEDKNISS, having no direct or indirect connection with the various transactions taking place on OUEDKNISS.COM, cannot be held responsible.

In case of violation of the above rules or those stated in the GTU, SARL OUEDKNISS reserves the right to suspend access to the Individualized Space or secure pages or services and/or to terminate the agreement with immediate effect.

Article 5 OUEDKNISS's Limitation of Liability:

OUEDKNISS.COM is limited to hosting the ads posted by the User, and it does not intervene in the transaction process; therefore, SARL OUEDKNISS assumes no responsibility towards the User.

SARL OUEDKNISS only verifies the consistency of the information published by the User and relies on the assumption that the data transmitted by the User is accurate and complete.

SARL OUEDKNISS cannot be held responsible for damages resulting from the User's behavior, especially contractual or tortious breaches committed by the User or any other behaviors from users.

SARL OUEDKNISS is not responsible to the User for any possible degradation, suspension, or interruption of access to secure pages or services attributable to force majeure.

SARL OUEDKNISS cannot be held responsible for the opinions and comments, hyperlinks, published by the User, leading to domains or sites contained therein. OUEDKNISS.COM and its various services may be interrupted or suspended by SARL OUEDKNISS, notably for maintenance, without prior notice or justification.

Article 6 Requirements for User Reviews:

User reviews posted on OUEDKNISS.COM allow the evaluation of a product or service posted by the User and the evaluation of the User who posted the product or service.
Reviews are represented by a heart-shaped icon, and the number of clicks on the heart-shaped icon will be visible to Users during a possible search or consultation of the ad published on OUEDKNISS.COM. Each User can only submit one review, and the User agrees not to submit a review whose content they know is false.

Article 7 Requirements for Comments Issued by Users:

OUEDKNISS.COM allows the User to make comments on the various ads posted on OUEDKNISS.COM as long as the message content does not violate the law.

Any message posted on OUEDKNISS.COM with a political, religious, obscene, defamatory, slanderous, threatening, or racist character, or any advertising message or, in general, violating the law, is strictly prohibited.

The User who notices that any message posted on OUEDKNISS.COM violates the provisions of these GTU must report it to OUEDKNISS.COM via the reporting tab available in the interface of each ad or by any means made available by OUEDKNISS.COM. Necessary measures will be taken against the violator.

Article 8 Requirements for the Use of OUEDKNISS.COM Messaging:

OUEDKNISS.COM allows the User to send messages to another User of OUEDKNISS.COM as long as the message content does not violate the law.

Any message sent through the OUEDKNISS.COM messaging service with a political, religious, obscene, defamatory, slanderous, threatening, or racist character, or any advertising message, or, in general, violating the law, is strictly prohibited.

The User who receives any message that has violated the provisions of these GTU must report it to OUEDKNISS.COM by any means made available by OUEDKNISS.COM. Necessary measures will be taken against the violator.

Article 9 Intellectual Property:

The content posted by SARL OUEDKNISS through OUEDKNISS.COM or in connection with the Service Store, such as texts, graphics, logos, buttons, images, data compilations, is the exclusive property of SARL OUEDKNISS. Any reuse, extraction of all or part of the aforementioned content or service is strictly prohibited and must be subject to prior written authorization from SARL OUEDKNISS.

SARL OUEDKNISS assumes no responsibility for any fraudulent use that may emanate from the User and may infringe on the intellectual property rights of a third party. Any User who shares and publishes non-personal content, images, texts, information grants SARL OUEDKNISS a universal, irrevocable, royalty-free license to reproduce, modify, distribute, display, create derivative works from non-personal content, images, texts, and information.

Article 10 Modification of GTU:

These GTU are subject to change or update. For this purpose, they will be presented to the User who must accept their content.
These modifications will be effective upon their publication and cannot apply to operations carried out before. The User should refer only to the online version on the date of consultation.

Article 11 Competent Jurisdiction:

These GTU are subject to Algerian law for their validity, interpretation, and execution.
Subject to applicable public order provisions regarding jurisdiction, the court in the jurisdiction of the registered office of SARL OUEDKNISS will be solely competent to hear any dispute relating to these terms.
